Cancellation Policy
CONDITIONS OF HIRE Bookings: Please phone or email us to arrange available dates and we will tentatively book your vessel. A deposit of $350 is required to confirm the booking (and a receipt will be posted). The balance of the charter fee is required 30-days prior to departure. If the booking is made within the 30-day period the balance is required within 7-days. Security Deposit: A security/insurance bond of $1 000 is required on the day of departure. This is held as a credit card authorisation. The bond will be refunded within 7-days of your return less fuel cost of any repairs or damage to boat/s or equipment and cost of any extra cleaning required. Travel Insurance: Travel insurance against cancellation of booking is available at the hirer?s cost and is recommended. Payment: Can be received as cash direct transfer into our bank account credit card or 65-days in advance for personal cheques. Hire Times: Departure briefs can be conducted anytime between 8:00am - 3.00pm depending on briefing schedule and arrival (charter completion) times is 8.30am. Changes to these times may be arranged subject to availability. Fuel: Is charged at $40 per houseboat cruising hour. Among other things this covers fuel for the houseboat & tender gas for the BBQ cooking. fridge and hot water. Hirer?s Agreement: A contract stating the conditions under which the boat is hired will be entered into before commencement of the hire period. Provided this contract is adhered to liability for damage to the boat or equipment will be limited to the amount of the security bond. Hire Conditions: No "bucks" or "hens" parties. No pets or firearms are permitted on board at any time. Letting of the vessel is on the understanding that it is at the disposal of the hirer on the dates booked unless management is prevented from doing so. In this case all money will be refunded in full. The hirer shall have no claim whatsoever against management. All boats are fully insured under commercial marine policies. Hirer?s liability (provided terms of the hirer?s agreement have been kept) is the $1 000 security/insurance bond plus fuel etc. Cancellations: Bookings cancelled prior to final payment; deposit is refunded less $50 processing fee. Refund of any money will depend on the vessel being let for the same or similar period. If less than 30-days notice is given the following charges may apply: 30-22-days ? 25% of hire cost 21-15-days ? 50% of hire cost 14-7 days ? 75% of hire cost under 7-days ? 100% of hire cost. Age: The nominated "skipper/s" must be over 21-years of age. This person/s (aged 21-years +) is ultimately responsible for the houseboat and must remain under legal alcohol limits at all times. Insurance: Our boats are fully covered by Commercial Marine Insurance Policies. The limit of liability for the hirer (provided the terms of the hire contract are adhered to) is the value of the security deposit. Anchoring: The vessel is not allowed to be moored or tied up to a fixed jetty floating jetty navigation marker or river bank and is not to be rafted up to any other vessel / personal watercraft (company tender excluded). Operating Area: The vessel shall not be operated outside of the oprational area or within the "no go" areas as defined on the chart/map displayed in the vessel. The Northern boundary is the entrance to Lake Cootharaba and the South Eastern boundary is as far as the T-Boat hire building along Gympie Terrace. Operating Hours: The vessel shall not be operated as follows: May June and July: after 4:30pm. All other months: after 5:00pm. The vessel should be safely anchored prior to the time above with your overnight location relayed to base and the anchor light displayed until sunrise. Termination of hire: The Company may terminate the charter if it is deemed at the sole discretion of the owner that the hirer is in breach of any of the conditions of hire or is abusing the use of the vessel in any way. If the hire is terminated by the company the charter fee will be charged to the hirer in full. The Charter: The vessel is placed at the disposal of the hirer on the date booked unless the company is prevented in doing so by mechanical breakdown or unforeseen circumstances. In this case pro-rata monies paid by the hirer will be refunded in full however the hirer shall have no claim on any account agains the company whatsoever in relation to the cancellation of hire. The Vessel: The vessel and equipment must be returned in as good order and condition as when hired. Additional cleaning fees will be imposed if the vessel is returned in an untidy or filthy state. If the hirer causes any damage to the vessel/s it must at the Company's request rectify the damage or pay monetary compensation to the Company for the damage within 7-days of the request. No Warranty: Except as required by law the Company gives no warranty whatsoever in relation to the operational condition of the vessel. The Hirer will have no claim against the Company in respect of any loss damage or injury arising out of the operational condition of the vessel. Indemnity: The Hirer is liable for and irrevocably and unconditionally indemnifies the Company against all liability loss penalties payments costs charges and expenses directly or indirectly arising out of the Hirer's failure to comply with the terms and conditions of the hire agreement and any Local State and Commonwealth laws relating to the use of the waterways. Medical Conditions: The Hirer must advise if there is any medical condition that would prevent them from operating the vessel safely.
